- All the personal data we process is processed by our staff in the UK, however for the purposes of IT hosting and maintenance this information is located on servers within the European Union. The UK Secretary of State has issued an adequacy decision in relation to countries within the European Union which means we are able to transfer data there under data protection laws.
- We do not transfer your data to any locations outside the UK or European Union.
We may transfer information to third party providers for our legitimate interests or where we are required to do so by law. We collect personal data about you to allow us to provide you occupational health services, on behalf of your employer. This may include your full name, date of birth, address (home and work), telephone numbers, email addresses, employee number, details of your work and gender. It may also include sensitive information about your health, trade union membership and disability status.
We are committed to protecting the privacy of your personal data. We will respect any personal data you share with us and keep it safe. We aim to be clear when we collect your personal data and not do anything you wouldn’t reasonably expect.

Optima Health may act as either a ‘Controller’ or a ‘Processor’ of personal data provided to us, depending on the circumstances of data transfer, usage and specific arrangements in place with your employer. Optima Health will act as a Data Processor in all circumstances for referrals to service made by your employer and outcome reports issued to your employer as they alone define the purpose for processing and they are for their purposes.
Optima Health processes personal and special category data on the basis of legitimate interests and occupational or preventative medicine.
This document relates to services delivered under occupational health contracts only. Our ‘EAP’, ‘Wellbeing Services’ and ‘DART’ Privacy Notices are available to all service users and these should be referenced with regards these products specifically.
Why we need your data
The aim of occupational health is to prevent work-related illness and injury by:
- encouraging safe working practices
- ergonomics (studying how you work and how you could work better)
- monitoring the health of the workforce
- supporting the management of sickness absence
- An occupational health service might also:
- work with your employer to implement safe working practices and ensure health and safety compliance
- conduct pre-employment health assessments
- support health promotion and education programmes
- provide advice and counselling to employees around non-health-related problems
- provide your employer with advice and guidance around making reasonable adjustments to your working conditions
- provide advice to your pension provider about whether you meet the medical criteria in your scheme.
How is Occupational Health provided?
Occupational health provision will depend on the specific services procured by your employer. It can be provided by a nurses and doctors, or through a range of specialists, including:
- physiotherapists
- hygienists
- psychologists
- ergonomic experts
- occupational therapists
- mental health specialists
- specialist occupational health nurses and doctors.
We need to receive your personal data in order to provide occupational health services on behalf of your employer. We will not collect any personal data from you we that do not need in order to provide and oversee this service.
Lawful basis for processing
We need to have a so-called “lawful basis” under data protection law to process your personal data. We are also required to possess a lawful basis for processing ‘special catgeory’ data. In the context of Occupational Health, data pertaining to your health is ‘special category’ data. We process your data based on the following lawful bases:
- Legal obligation – e.g. HMRC rules, TUPE, HSE guidance, request by a court or legal body for information (subject to appropriate conditions being met)
- Legitimate interest – for the legitimate interests of Optima Health servicing its contracts with its clients and those interests of its clients for whom it delivers the services
- The provision of preventative or occupational medicine – for the processing of special category, ‘health’ data and other special category data which may be recorded where this is pertinent to your health or an individual case
- Consent – where no legal obligation or contractual requirement or legitimate interest is met as the Article 6 UK GDPR basis – then Optima Health will only process data with explicit consent by exception.
- Explicit Consent – where no legal obligation or contractual requirement or legitimate interest is met as the Article 6 UK GDPR basis and where there is no alternative reasons as the Article 9 UK GDPR basis – then Optima Health will only process special category data with explicit consent.
We do not rely on consent as a basis for processing your data routinely and are unable to do so due to the inherent imbalance of power in the employer/ employee relationship, the fact that this may constitute a requirement of your employment and that we cannot guarantee service provision or no detriment to the data subject in the event of consent withdrawal. This basis will therefore only be relied on in rare circumstances, by exception and data subjects will be notified of this prior to processing.
As a provider of clinical services, we do seek your clinical consent (as defined by General Medical Council guidance) to referral, assessment and subsequent production of a report. This does not constitute consent to processing, as defined by UK Data Protection legislation.
What we do with your data
All the personal data we process is processed by our staff in the UK, however for the purposes of IT hosting and maintenance some information is stored on servers within the European Union. We transfer information to third party providers such as government authorities, regulators, the Court and law enforcement where we are required to do so by law and where such a transfer forms part of the provision of the occupational health service. We may transfer your information to individuals, companies and organisations that carry out occupational health service interventions on our behalf, such as clinicians, wellbeing service providers, other companies or individuals delivering health interventions, assessments or laboratory services.
The Company may share your data with a third party purchaser if there is a business sale.
We use algorithms for pre-employment fitness assessment purposes to assess fitness for work. No individual will be deemed unfit for work based on the results of the algorithm without being checked by a Medical Professional. This does not constitute ‘automated decision making’.
We may utilise an Artificial Intelligence tool to create draft clinical notes and reports which are then made available to the clinician undertaking your assessment for review and any necessary amendment before being added to your occupational health record. This shall only be utilised on contracts where your employer has approved use and you will always be informed of intended use prior to any recording of your information. You have the right to object to use of the tool. The tool utilised has been specifically developed for use in the healthcare field and this will not store any of your data for longer than 14 days. Notes and outcome reports will continue to be stored within your occupational health record only.
We have a Data Protection regime in place to oversee the effective and secure processing of your personal data. Our Data Protection Officer, Chief Medical Officer and/ or a Senior Clinical Director may also act as our Caldicott Guardian, where it is necessary and appropriate to do so. Under the Caldicott Principles a Caldicott Guardian is a senior person responsible for protecting the confidentiality of patient and service-user information and enabling appropriate information‑sharing of clinical data.
How long we keep your data
We keep your data in line with our data retention policies; how long this is kept will depend on the data we have collected, and the legal requirements associated with it. What are your rights?
Right of access
You are entitled to see a copy of the personal data we hold on you. Should you wish to see the personal information we hold please contact, detailing the information you wish to see.
